Runout Poker Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Runout Poker mobile application, website, and related services (collectively, the “Service”) provided by Runout Poker (“Runout Poker,” “we,” “our,” or “us”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or guardian.

By using the Service, you represent that:

  • you meet the eligibility requirements

  • you have the authority to enter into these Terms

2. License to Use the Service

Subject to these Terms, Runout Poker grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

You may not:

  • copy or distribute the Service

  • reverse engineer or decompile any part of the software

  • attempt to access source code

  • create derivative works

  • resell access to the Service

  • use the Service for commercial training platforms

  • scrape or extract data

  • use bots, automation, or scripts

  • attempt to circumvent security controls

Any unauthorized use terminates your license immediately.

3. Accounts

Some features require an account.

When creating an account, you agree to:

  • provide accurate information

  • maintain the security of your login credentials

  • accept responsibility for activity on your account

You are responsible for maintaining the confidentiality of your password.

Runout Poker is not liable for losses caused by unauthorized use of your account.

We reserve the right to suspend or terminate accounts that:

  • violate these Terms

  • abuse the Service

  • disrupt the platform

  • attempt to exploit the system

4. Intellectual Property

The Service and all related content, including but not limited to:

  • software

  • algorithms

  • poker training content

  • strategy explanations

  • puzzles

  • game simulations

  • design

  • trademarks

  • logos

  • data models

  • machine learning systems

are the exclusive property of Runout Poker and its licensors.

These materials are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers ownership of any intellectual property.

5. User Data and Feedback

You may provide information or feedback when using the Service.

By submitting feedback, suggestions, or ideas, you grant Runout Poker a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Service.

We may also use anonymized or aggregated usage data to improve the Service.

6. Educational Disclaimer

Runout Poker provides educational poker training tools.

The Service does not guarantee poker performance, winnings, or financial outcomes.

Poker involves elements of skill, probability, and risk.

Users acknowledge that:

  • results vary

  • no outcomes are guaranteed

  • the Service is provided for training purposes only

7. Subscriptions and Payments

Some features of the Service may require payment.

Payments made through the Apple App Store or Google Play Store are processed by those platforms.

Billing, subscription renewal, and refund policies are governed by the policies of the respective app store.

Subscriptions may automatically renew unless canceled through the applicable platform.

8. Acceptable Use

You agree not to:

  • violate any applicable laws

  • interfere with the Service’s operation

  • access non-public systems

  • attempt to hack or disrupt the platform

  • use automated tools to scrape content

  • exploit bugs or vulnerabilities

  • impersonate other users

We reserve the right to investigate and take appropriate action against violations.

9. Third-Party Services

The Service may rely on third-party services such as:

  • authentication providers

  • analytics providers

  • cloud hosting services

These services may be subject to their own terms and policies.

Runout Poker is not responsible for third-party services.

10. App Store Terms

If you download the App through Apple App Store or Google Play:

You acknowledge that these Terms are between you and Runout Poker, not Apple or Google.

Apple and Google:

  • are not responsible for the Service

  • have no obligation to provide maintenance or support

  • are not liable for any claims related to the App

Apple and Google may enforce these Terms as third-party beneficiaries.

11. Updates and Changes

Runout Poker may update, modify, or discontinue parts of the Service at any time.

We may also release updates that change functionality or features.

Continued use of the Service after updates constitutes acceptance of those changes.

12. Termination

We may suspend or terminate your access to the Service if:

  • you violate these Terms

  • your use harms the platform or other users

  • we believe termination is necessary for security or legal reasons

Upon termination, your license to use the Service ends immediately.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the fullest extent permitted by law, Runout Poker disclaims all warranties, including:

  • merchantability

  • fitness for a particular purpose

  • non-infringement

  • uninterrupted operation

  • error-free performance

We do not guarantee that the Service will always be available or secure.

14. Limitation of Liability

To the maximum extent permitted by law, Runout Poker shall not be liable for any:

  • indirect damages

  • incidental damages

  • lost profits

  • loss of data

  • business interruption

arising from your use of the Service.

Our total liability shall not exceed:

$100 USD or the amount you paid for the Service in the past 12 months, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Runout Poker and its affiliates from any claims, damages, or expenses arising from:

  • your use of the Service

  • your violation of these Terms

  • your violation of applicable law

  • infringement of third-party rights

16. Arbitration Agreement

You and Runout Poker agree that any disputes will be resolved through binding arbitration, rather than court litigation.

Arbitration will be conducted under the rules of the American Arbitration Association.

Arbitration will take place in the United States.

17. Class Action Waiver

You agree that disputes will be resolved individually.

You waive the right to participate in:

  • class actions

  • class arbitration

  • representative lawsuits

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

19. Changes to These Terms

We may update these Terms periodically.

If we make material changes, we will update the “Last Updated” date.

Your continued use of the Service after changes constitutes acceptance of the updated Terms.
